MA Industries announced today that yesterday, January 18, 2009, it was informed that a claim and a petition to regard the claim as class action were filed against its wholly owned subsidiary, Agan Chemical Manufacturers Ltd. (Agan). The claim was filed with the District Court of Be'er Sheva by a resident of Ashdod, referring to alleged damages caused by the hardship related to a fire incident at a warehouse within Agan facility in Ashdod. The claim and the petition have not yet been served to Agan. The plaintiffs estimate that in the event the claim is regarded as class action, it would amount to Shekel equivalent of approximately $25 million. At this stage, Agan cannot estimate the likelihood of the claim and the petition to proceed.
